1. Acceptance of Terms

Welcome to BitoCircle, a crypto-native social media platform designed for cryptocurrency creators, traders, and enthusiasts. These Terms of Service ("Terms") govern your access to and use of BitoCircle's services, including our website, mobile applications, and any related services (collectively, the "Platform").

By creating an account, accessing, or using BitoCircle, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Creator Guidelines.

2. Eligibility

To use BitoCircle, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Comply with all local laws regarding online conduct and cryptocurrency transactions
• Not be located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country

3. Account Registration

3.1 Account Creation

To access certain features of BitoCircle, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password
• Enable two-factor authentication (2FA) when available
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with third parties

3.3 Creator Accounts

Creator accounts are subject to additional verification requirements and must comply with our Creator Guidelines. BitoCircle reserves the right to verify your identity and reject or suspend accounts that do not meet our standards.

4. Cryptocurrency and Web3 Integration

4.1 Crypto Wallet Connection

BitoCircle allows you to connect cryptocurrency wallets to your account for payments and transactions. You acknowledge that:

• BitoCircle does not custody your cryptocurrency assets
• You are solely responsible for the security of your wallet and private keys
• Cryptocurrency transactions are irreversible and final
• BitoCircle is not responsible for losses due to compromised wallets or incorrect transaction details

4.2 Payments and Transactions

All cryptocurrency payments processed through BitoCircle are subject to blockchain network fees and confirmation times. BitoCircle may charge platform fees for certain transactions, which will be clearly disclosed before completion.

4.3 Tax Obligations

You are solely responsible for determining what, if any, taxes apply to your cryptocurrency transactions and for reporting and remitting the correct tax to the appropriate tax authority. BitoCircle is not responsible for determining the taxes that apply to your transactions.

5. User Content and Conduct

5.1 Content Ownership

You retain ownership of all content you create and share on BitoCircle ("User Content"). By posting User Content, you grant BitoCircle a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Platform.

5.2 Prohibited Content

You agree not to post, share, or promote content that:

• Promotes fraudulent cryptocurrency schemes, scams, or rug pulls
• Contains false or misleading financial advice
• Violates intellectual property rights
• Contains illegal content or promotes illegal activities
• Is hateful, threatening, or harassing
• Contains malware, phishing attempts, or security threats
• Impersonates others or misrepresents your affiliation
• Promotes pump-and-dump schemes or market manipulation

5.3 Content Moderation

BitoCircle reserves the right to remove any content that violates these Terms or our Community Guidelines. We may also suspend or terminate accounts that repeatedly violate our policies.

6. Creator Monetization

6.1 Revenue Sharing

Eligible creators may monetize their content through various methods including brand partnerships, subscriptions, tips, and NFT sales. BitoCircle retains a platform fee (as disclosed in your creator agreement) from monetization activities.

6.2 Payment Processing

Payments are processed in cryptocurrency (BTC, ETH, USDT, or other supported tokens) and are subject to:

• Minimum payout thresholds
• Blockchain network transaction fees
• Payment processing times (typically 7-14 days)
• Verification and compliance checks

6.3 Brand Partnerships

All brand partnerships facilitated through BitoCircle must comply with applicable advertising laws and disclosure requirements. Creators must clearly disclose sponsored content.

7. Intellectual Property

BitoCircle and its licensors own all rights, title, and interest in and to the Platform, including all intellectual property rights. You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.

The BitoCircle name, logo, and related marks are trademarks owned by BitoCircle. You may not use these marks without our prior written consent.

8. Disclaimers and Limitations of Liability

8.1 No Financial Advice

8.2 Platform Availability

BitoCircle is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Platform will be available at all times or free from errors, viruses, or other harmful components.

8.3 Cryptocurrency Risks

You acknowledge that cryptocurrency markets are highly volatile and speculative. BitoCircle is not responsible for any losses resulting from cryptocurrency price fluctuations, failed transactions, or blockchain network issues.

8.4 Limitation of Liability

To the maximum extent permitted by law, BitoCircle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or cryptocurrency assets.

9. Indemnification

You agree to indemnify, defend, and hold harmless BitoCircle, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of the Platform
• Your User Content
• Your violation of any third-party rights

10. Termination

BitoCircle may suspend or terminate your account at any time, with or without cause or notice, including for violations of these Terms. Upon termination:

• Your right to access the Platform will immediately cease
• Any pending cryptocurrency payments may be withheld or returned
• Your User Content may be deleted
• You remain liable for any outstanding obligations
